Deeming Rule and Tin Warnings

With the August tin and cigar box warning label date fast approaching arising from the FDA "Deeming Rule", has anyone heard anything about implementation of this new requirement whereby warning labels regarding smoking must be plastered on tins and cigar boxes?   The Cigar Rights of America website had an update a while back, but I'm just wondering if the intent is to enforce the rule in August, table it or toss it altogether?  A recent YouTube video from "StuffandThings" begged the same question after the presenter purchased tins of Elizabethan Mixture with warning labels covering a third of the front of the tin. It was unclear if the tins were simply European tins he purchased from an American tobacco website or the rule was being enforced already.

I have not heard anything official.  However, I received an order a few days ago from Country Squire where I purchased some Presbyterian tobacco.  Half the label is covered with a black & white warning label on it.  Thought at first this was an imported tin from the EU.

@Charles Great.  It's looking more and more like the August date is going to be triggered.  Cigar box artwork will be a thing of the past.  Why would a manufacturer want to bother with the expense of decorating their boxes if 1/3 of the box is plastered with this BS?  This is very disappointing.

Seems like the warning labels could be affixed to a cellophane wrapper leaving the actual container alone. Damn shame.

Well if we have to put up with this stupid idea, maybe the tobacco company could use the space at the bottom to date the tobacco. But probably part of the deeming rules are that no one can do anything to the warning label.

I'm waiting for the day when a package of Twinkies contains a similar health warning: "Warning: This product contains fat which can cause your ass to expand to the size of two pumpkins."

Out of curiosity, I went through my cellar and found the label on my HH VS tins. The tins have the warning on both sides and are dated 10/17.  It's not a sticker applied over the label, it's part of the actual label.

This article sums up where the fight against the warning label issue specifically is in the courts.  It's quite possible the decision to require them will be appealed and according to the article rescinded.  It's effective in August but as @Kmhartle and @Charles have shown us, the industry is complying already which is most unfortunate. 

There are also efforts to overthrow the FDA's Deeming Rule through federal legislation.  I've attached the CRA link below so everyone is aware of what's going on.

Please excuse my attitude, but putting those labels informing us that tobacco contains nicotine is like putting labels on bottled water: "DANGER you may get wet if spilled"... Can someone find an adult out there that doesn't know tobacco contains nicotine? What's the point? Just sayin'...

The point, @KA9FFJ? We both know there’s no “point”. It’s appeasement that accomplishes nothing.....and there’s a hell of a lot of it out there these days. Pardon me, but I’m very disappointed in the state of things all around and could easily tip into a rant.

I’ve decided to enjoy the endangered traditions I choose to while I can rather than keep swimming upstream and getting annoyed. As Louis Prima sang, “Enjoy yourself, it’s later than you think” 😉

I agree with you but I was just thinking of it from a different perspective.  It's another example of government intrusion into our lives.  It's unfortunate that the artwork on tins, but also and particularly on cigar boxes, will be covered up with ugly warnings.  I'm a firm believer in "you give them an inch...."  when it comes to the government. This isn't the most damaging provision of the Deeming Rule, but it certainly is part of the problem.

The required implementation of warnings for cigar and pipe tobacco were delayed by a federal court back in July. That being said, as the deadline for implementation was August, most manufacturers had already gone through the long and costly process of implementing the warnings. So not required at this time, but you'll likely continue to see them on various packages.

@Leonard Thanks for the update.  I had heard implementation was being postponed.  I'm hoping it's thrown out altogether.  By the way, nice to see you on the discussion page.

My local tobacconist told me once "Politicians will never push for more restrictions on cigars cuz that's what they smoke"  Looks like that statement didn't hold up. Of course he also believes the gov't is poisoning the water to reduce the population, then again he's found me some phenomenal cigars and pipe tobacco.
